If you becoming an Academy, the local Authority will no longer be the employer of staff within your school. Staff will transfer to become employees of the new Academy Trust.

The TUPE regulations were put in place to protect employees when transferring from one employer to another with the purpose of preserving the terms and conditions of staff when TUPE applies. As the new employer you are required to ensure that the appropriate legal requirements are adhered to.

Although the principle of TUPE is simple, the actual application can be a complex process. Cambridge Education has worked in partnership with Governors and leadership teams to facilitate the successful TUPE transfer of over 30 academies as well as the initial TUPE pilot of the first Academies on behalf of what was then the DCSF. We have also worked with schools that are merging to support restructuring and organisational change projects.
